Processing of personal data
Access to some sections of the www.aquafil.com, www.econyl.com and www.dryarn.com sites (individually and with reference to this informative communication, called “Site”) and/or any requests for information or services from users of the Site may be subject to the inclusion of personal data whose processing by Aquafil S.p.A. (as Data Controller), takes place in compliance with Regulation (EU) 2016/679 (“GDPR”) and of Legislative Decree no. 196/2003 and following modification and/or integration (“Privacy Code”).
This informative communication is intended to allow users to know, even before accessing the various sections of the Site and to provide their data, how Aquafil S.p.A. deals with personal data and it will however be necessary for the user to take note of it before giving personal data by filling in the appropriate spaces in the various sections of the Site.
Purpose of the processing and legal basis
The registration of users on the Site is not required for the provision of certain services offered by Aquafil S.p.A.. However, to deal with any requests from users regarding these services, the same users will be invited to provide personal data, which will only be processed purpose and for the strictly necessary time.
According to the needs expressed from time to time by the user who accesses the various sections of the Site, the purposes of processing personal data provided directly by users by filling in the online forms may be as follows:
a) allow registration on the Site, necessary for access to particular sections of the same Site and to provide and manage the various services offered. This treatment is based on the provision of a service at the request of the user;
b) carry out marketing activities (such as, merely by way of non-exhaustive example, sending information, promotional and advertising material); and this also by e-mail, fax, mms and sms, without prejudice to the right of the data subject to oppose such processing at any time.
It should be noted that the processing of data carried out for the purposes referred to in point b) is based on the legitimate interest of Aquafil S.p.A. to inform users who visit the company’s Site and/or its products about the main news and developments concerning the products themselves and the sectors of reference, and this also through the transmission of communications for information and commercial purposes.
The information activity described is carried out on the assumption that the user is interested in staying up-to-date on the most relevant news, guaranteeing that he can oppose the receipt of such communications by means of the specific link at the bottom of the same.
Categories of personal data processed and methods of processing
Aquafil S.p.A. acquires personal data directly from users by entering such data in the sections of the internet sites indicated below.
• “Work with us” section
• “Contact Us” section
which allow the user to contact Aquafil S.p.A. through a specific form.
To this purpose, the Data Controller acquires personal data of the interested party, as specified below.
– first name
– Postal Code
- e-book downloads “5 Reasons for Interior Designers and Architects to use Sustainable Materials”;
- access to the webinar “Innovation in Materials Production – Principles of Sustainability and Case Studies” and download of relevant supporting material;
- any other proposal concerning the downloading of informative material in any electronic format.
To this purpose, the Data Controller acquires personal data of the interested party, as specified below.
– name and surname
Personal data will be processed in a mainly automated form, with logic strictly related to the aforementioned purposes.
Nature of the delivery of personal data of users and consequences of a refusal to respond
The delivery of “mandatory” personal data (marked on the Site by an asterisk) is necessary in order that Aquafil S.p.A. can satisfy the user’s needs within the functionality of the Site.
Failure, partial or incorrect delivery of the aforementioned mandatory personal data, does not make it possible to perform the requested service.
Failure, partial or incorrect conferment of optional personal data does not imply any consequences for the interested party.
Scope of communication or disclosure of users’ personal data
Personal data provided directly by users through the completion of online forms will not be disclosed to third parties or released.
Personal data may be brought to the attention of employees or collaborators of the Communication Office and the Human Resources Department of the Data Controller who operate under the direct authority of the latter, according to the operating instructions defined by the same.
Information for the identifications of the Data Controller and Data Processors
The Data Controller is Aquafil S.p.A., via Linfano 9, Arco, 38062.
The entity in charge of the processing is Verter S.r.l., based in Verona, via Germania n. 4, with reference to the management of the Site and the servers on which it is hosted, as well as the storage of personal information of users.
It should be noted that the complete and updated list of the aforementioned subjects to whom data may be communicated as data processors may be requested through the use of one of the communication channels made available to the Company for the exercise from interested parties of their rights, indicated below.
Storage of personal data
Subscription to the newsletter and its processing are considered valid until the cancellation by the user, possible through the appropriate link at the bottom of each e-mail.
Transfer of personal data abroad
Aquafil S.p.A. does not transfer the data of users of the website to third parties; however, it should be noted that the management of the servers to which the Site is hosted, entrusted to Verter S.r.l., could result in the transfer of some data outside the European Economic Area (eg. USA, Japan). In this regard, Verter S.r.l. guarantees that, in such situations, the
data recipients ensure the same data protection standards, thanks to appropriate technical, organizational and legal measures.
Users’ rights recognized by Articles 15-20 of the GDPR
Pursuant to Articles from 15 to 20 of the GDPR the interested parties have the right to obtain, at any time:
- confirmation of the existence or not of a treatment that concerns them and access to their data, including information regarding: – the purpose of the processing;
– the categories of personal data being processed;
– the recipients to whom the data are or will be communicated;
– the possible transfer of data outside the European Union and the existence of the relative guarantees;
– the retention period of the data or the criterion for determining it;
– any right to rectification and deletion of data, limitation and opposition to processing;
– the right to lodge a complaint with the supervisory authority;
– the origin of the data, if the data were not collected by the data subject;
– the existence of an automated decision-making process.

- the limitation of the processing of personal data;

Pursuant to Articles 21 and 22 of the GDPR, moreover, the interested parties have the right to:
- oppose at any time, for legitimate reasons connected to their situation, the processing of data concerning them and necessary for the performance of tasks of public interest or for the pursuit of the legitimate interest of the owner;
- not be subjected to decisions based solely on automated processing, which may have legal effects or significantly affect the person concerned.
In particular, the interested party may at any time oppose the sending of communications related to commercial activities, marketing and profiling by selecting the option “delete” at the bottom of the e-mail containing the newsletter.
Right to propose a complaint to the Supervisory Authority
Pursuant to Article 77 of the GDPR, the interested party has the right to lodge a complaint with the Supervisory Authority if he considers that a treatment that concerns him violates the provisions of the law regarding the protection of personal data in force.
How to exercise the rights referred to in Articles 15-20 of the GDPR
The user may, at any time, exercise the aforementioned rights:

The exercise of the rights mentioned above can be exercised directly or by conferring, in writing, delegation or power of attorney to individuals or associations.
